I am writing to inform you that I work for the Media Agency Associated Press (Moldova) and we do have a contract signed with your company Protectall Insurance Company specifying the guarantees and situations subject to provisions of the signed Insurance Contract.
Recently, on the 13 March until the 15 March I have been on a field trip in the conflict zone in Ukraine, Donbass to document the psychological state of the local population who are compelled to live in the conditions of continuous tension and psychological strain because of the close vicinity of the theatre of the on-going war. The terror, people live in, is caused by the what they hear and what they see going on around them: explosions from air raids and from the field, rampant shooting night and day, disappearance of people who become lost without any trace definitely, death. The aggressive, threatening military troops are laying in ambush and preying on the peaceful population all the time; the continuous long-time panic and perceived feeling of personal insecurity and helplessness in helping own dear ones is expressed in a heavy psychological trauma, people suffer of PTSD, which is a serious disorder with consequences.
That was a three day crusade very rich in valuable documentary materials that are going to be used, materialized in a documentary, with eyewitnesses’ testimony and interviews of people who have the duty and mission to manage the situation, how they cope, and the critical shortages they suffer from; a real-life footage of the humanitarian catastrophe that is unfolding in the region.
However, my concrete complaint is about the deceptively low level of organization of the trip by the local authorities. The APM hired from a specialized agency and placed at our disposal a bullet-proof Land Rover specifically for such missions. It turned out that it was not bullet-proof, we could taste the firing of hidden in the bushes hostile patrols; the driver was not a professional one, had a fake driver’s license, in addition did not have the least knowledge of how to read a GPS system information, so he could not orient in the geographical space at all. When we arrived on a dangerous territory he vanished away, leaving us, me and my partner – a young camera-man, alone astray, without any clue how to get to the nearest locality and get where we wanted. We disembroiled on our own account how well we could. After we had completed the mission successfully and got back, we discovered with absolute stupor that the transportation firm taxed us for the services they failed to execute with honour 5000 % higher than the initial deal. The mission was a secret one, so the services were expensive enough, but after having cowardly defected and put our lives in jeopardy and subjected us to additional inconveniences, the agency owe to us moral damages and a complete recuperation of payment for services. What we had paid for the rent of the vehicle is the only payment we are willing to make for them.
We reiterate we are not going to pay the exorbitant sum they are asking for their non-compliance with the signed agreement and not executed services. We require them to pay to us moral damages for the psychological trauma we suffered through their fault and non-agency.
We give them a term of 10 days in which they should contact you and settle all the details, your experts would establish the facts for them in accordance with the documents package we are going file. In case they fail to honour their obligations this time again in due term, we are going to proceed to legal settlements and promise them positively that their “agency” is going to be closed with opprobrium and a huge scandal, judiciary consequences included.
We would like to renew our assurances of consideration for the sustainable trustful collaboration that we had had and expectation for this to continue.
Faithfully, APM.
